Terms and Conditions
These terms set out the rules for using the Immortal website and joining the waitlist. We have kept them short and clear. Please read them, because by using the website or joining the waitlist you agree to them.
01About these terms
The Immortal website and waitlist are operated by the team behind Immortal, based in the Republic of Slovenia (“Immortal”, “we”, “us” or “our”). These Terms and Conditions (“Terms”) form an agreement between you and us about your use of the website and the waitlist.
If you do not agree to these Terms, please do not use the website or join the waitlist. Nothing in these Terms limits any rights you have as a consumer that cannot be limited or excluded by agreement under the law that applies to you.
02Immortal is not launched yet
Immortal is a personal longevity app that is still in development. Everything shown on this website, including the product film, screens, features and texts, is a preview of what we are building. Features may change, be added or be removed before or after launch.
We currently plan to launch in November. This is a target, not a promise. We may change the launch date, launch in some countries before others, or decide not to launch, and we are not liable for doing so.
When the Immortal app launches, its use will be governed by separate terms and a separate privacy notice, which you will be able to read before you create an account. These Terms do not cover the app.
03The waitlist
- Joining the waitlist is free and does not oblige you to buy anything or to create an account later.
- Joining does not create a contract for the Immortal app and does not reserve any price, feature, plan or launch date for you.
- We may invite people from the waitlist in stages, for example in the order they joined or by country. A place on the waitlist does not guarantee early access.
- Please join with your own email address, which you are entitled to use, and join only once.
- We may remove entries that are false, automated, duplicated or abusive.
- You can leave the waitlist at any time by using the unsubscribe link in any of our emails or by sending us a request through the contact form.
We will use your email address only as described in our Privacy Policy.
04Who can join
You must be at least 18 years old and able to enter into a binding agreement to join the waitlist. By joining, you confirm that you meet these requirements.
05Health information notice
Immortal is designed to support healthy habits. It is not a doctor, and nothing on this website is medical advice.
The content on this website, including anything about sleep, activity, nutrition, recovery, wearable data or longevity, is general information provided for informational purposes only. It is not medical advice, diagnosis or treatment, and it is not a substitute for the advice of a doctor or other qualified health professional.
Always consult a qualified health professional before making changes to your sleep, exercise, diet or medication, especially if you have a medical condition, are pregnant, or take medicines. Never ignore professional medical advice or delay seeking it because of something you have read on this website.
If you think you may have a medical emergency, call your doctor or the emergency number immediately. In the European Union, the emergency number is 112.
06Using the website
You may use the website for your own personal information. When using it, you agree not to:
- break any applicable law or infringe anyone else’s rights;
- submit false information, another person’s email address without permission, or automated or bulk sign ups;
- attempt to gain unauthorized access to the website, its servers or any connected systems, or test their security without our written permission;
- introduce viruses, malware or any other harmful code, or overload, disrupt or impair the website;
- scrape, copy or extract content from the website by automated means, except for search engine indexing that respects our settings;
- use the website, the Immortal name or our logo in a way that suggests a partnership with us or endorsement by us without our written permission.
We may block access to the website or remove waitlist entries if you breach these Terms.
07Intellectual property
The website and its content, including the Immortal name, logo, design, texts, screens, graphics and the product film, are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws. Except for viewing the website for your personal use, and any use the law expressly permits, such as private copying or quotation, you may not copy, reproduce, distribute, modify, publicly display or create derivative works from any part of it without our prior written permission.
If you send us ideas, suggestions or feedback about Immortal, you allow us to use them freely to improve our products, without any obligation to you. This does not affect how we handle your personal data, which is always governed by our Privacy Policy.
08Availability and changes
We provide the website free of charge, as it is and as it is available. We work to keep it accurate, secure and online, but we do not guarantee that it will always be available, uninterrupted or free of errors. We may change, suspend or discontinue the website or the waitlist, in whole or in part, at any time.
09Liability
Because the website and waitlist are provided free of charge, and to the extent permitted by law, we are not liable for any indirect or consequential loss, for loss of data, profit or opportunity, or for any loss arising from your reliance on information on the website, from the website being unavailable, or from a change to or cancellation of the launch.
Nothing in these Terms excludes or limits our liability for damage caused intentionally or through gross negligence, for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law, including mandatory consumer protection law.
10Links to other websites
The website may contain links to websites operated by others. We do not control those websites and are not responsible for their content, availability or privacy practices. A link does not mean that we endorse a website.
11Privacy
Our Privacy Policy explains what personal data we collect through the website and waitlist, how we use it and the rights you have. It forms part of the information we give you, but your rights under data protection law do not depend on these Terms.
12Changes to these terms
We may update these Terms when our services or the law change. The date at the top shows when they were last updated, and the new version applies from the date it is published. If we make a material change that affects people on the waitlist, we will tell you by email before it takes effect. If you do not agree to the updated Terms, you can leave the waitlist at any time.
13Governing law and disputes
These Terms are governed by the laws of the Republic of Slovenia, excluding its conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer living in another country, you also keep the protection of the mandatory provisions of the law of the country where you live.
Any dispute will be decided by the competent court in Slovenia. If you are a consumer living in the European Union, you may also bring proceedings in the courts of the country where you live, and we may bring proceedings against you only in those courts.
We would always prefer to resolve a concern directly, so please contact us first. Because the website and waitlist are free and involve no purchase, we do not currently recognize a provider of out of court consumer dispute resolution for them. The terms of the Immortal app will set out the dispute resolution options that apply to it.
14General provisions
- Severability: if any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force, and the affected provision is replaced by a valid one that comes as close as possible to its purpose.
- No waiver: if we do not enforce a provision straight away, we do not give up our right to enforce it later.
- Transfer: we may transfer our rights and obligations under these Terms to a company that takes over Immortal, for example a company established to operate it, as long as your rights are not reduced. We will tell you if this happens.
- Entire agreement: these Terms, together with the Privacy Policy, are the entire agreement between you and us about the website and the waitlist.
- Language: these Terms are written in English.
